
Are you breaking the law?
Since 1999, all employers have been required to undertake
a Fire Risk Assessment of their workplace. If you have not
then you are breaking the law and could face large fines and/or
even imprisonment for up to 2 years!
The Fire Precautions (Workplace) Regulations 1997 mean that
there is a statutory duty on employers to consider all the
risks and hazards affecting employees within their workplace.
If you employ more than 5 people then the findings must be
recorded and available for inspection. The Fire Authority
can inspect without prior warning and have permission to
enter all premises.
"It’s alright, I have a Fire Certificate"
Not necessarily so… all buildings, whether you have
a valid fire certificate or were exempt (not a designated
use under the Fire Precautions Act 1971), require that a separate
Fire Risk Assessment be undertaken.
Prohibition Notice closes local care home
Following the death of 10 residents in a home in Fife, Tyne
and Wear Fire Authority are visiting care homes in the region
to ensure they are complying with the workplace regulations.
They have the responsibility for supervision and enforcement
of the regulations and took enforcement action against a care
home that did not have an evacuation plan or a Fire Risk Assessment
in place.
Company prosecuted for inadequate Fire Risk Assessment
Following a near fatal fire at their premises, (stock and
building seriously damaged), the Director of a local company
was prosecuted for having an inadequate Fire Risk Assessment.
The workplace regulations require that a Fire Risk Assessment
is undertaken by a competent person, the company had carried
one out internally with unfortunate consequences.
